How does the foreclosure process work in Tennessee?

The foreclosure process, no matter how long or short, can be a nightmare for families going through it. The length of time it takes to complete a foreclosure can vary widely from state to state. In some areas, foreclosing on a home has been known to take two years or longer, especially during the height of the housing crisis. If you are facing a foreclosure in Nashville, you may be wondering how long you have to try to save your home.

According to RealtyTrac, Tennessee’s foreclosure process is practically lightning-fast compared to many other states. Tennessee is a non-judicial state when it comes to foreclosing on homes. This means that you will most likely not go to court if your home is being foreclosed upon.

What does happen, then, if a judge does not sign foreclosure papers? It means that a foreclosure trustee can begin the process to sell your home in as little as two months from the time you become delinquent on your loan. The trustee will need to send you written notification 20 days before the date of the sale, as well as publish the intent at least three times in a local newspaper. One the sale is completed, the home is no longer yours and the foreclosure is complete.

Fortunately, you may be able to reverse the foreclosure after you receive a notice of sale. You have the right to reclaim your home by getting current on your mortgage payments, as well as paying certain fees related to the foreclosure. The purpose of this blog post is to inform you of our state’s general foreclosure process, but is not meant to serve as legal advice.
