What Debt Collection Practices Are Prohibited Under the FDCPA?

Under the FDCPA, debt collectors are prohibited from contacting you “at any unusual time or place” that the debt collector knows or should know would be inconvenient for the debtor. In general and without further information, the act assumes that any time before 8 a.m. and after 9 p.m. would be inconvenient for the debtor.

Additionally, if you are represented by an attorney — and the debt collector is aware that you have a lawyer — the debt collector must communicate with you through your attorney. This means that an attorney can shield you from harassing phone calls and unwanted communications regarding your debt.
